David Lake Photography Ltd takes your privacy very seriously. This privacy policy has been prepared in line with the EUs General Data Protection Regulation (GDPR), which promotes fairness and transparency for all individuals in respect of their personal data. This privacy policy applies to all data we process and by using David Lake Photography Ltd you consent to our collection and use of such data.

SECTION 2 WHAT PERSONAL DATA WE COLLECT AND WHY WE COLLECT IT

As a data controller we collect a variety of data in order to deliver our services and we will manage your personal data transparently, fairly and securely.

We may ask you to provide us the following data: First and last names, contact numbers, email and postal addresses.

Being a photographic business, we also create and manage images as per our contractual agreement(s).

We use the above data to deliver our service to you and we collect this data on the following lawful basis to arrange or fulfil a Contract.

The David Lake Photography Ltd website does not require any personal information when you visit the site. Should you wish to provide your personal details on the course of a product related enquiry or in transacting to receive additional information any information you provide to us will be protected from unauthorised access. The details below state the exact way in which information practices are handled by David Lake Photography Ltd below;

Any Personal Information obtained regarding an enquiry will be stored within the medium in which it was received. Where a booking is made, relevant Personal Information provided by the client will be stored for a period of ten (10) years after the date of the event.

All electronic devices where your Personal Information is stored, for example, mobile phone, tablet and desktop, all contain passwords. Images are stored on external hard drives which are password protected. Any paper documents where your Personal Information can be accessed are stored in a secure, private location only accessible by David Lake Photography Ltd

Personal information shall not be shared with Third Party operators or websites, unless considered necessary when completing your transaction. For example, David Lake Photography Ltd uses Citrix Sharefile to distribute final photographs to clients; David Lake Photography Ltd  will use your name and images to complete this order. This Site holds no responsibility for privacy policies on other sites butendeavors to only work with GDPR compliant companies.

David Lake Photography Ltd may need to disclose Personal Information, when necessary, in the instance of insurance claim, or legal reason that may occur. Wherever possible David Lake Photography Ltd willinform those affected prior to the release of Personal Information.

IMAGES

GDPR legislation states that a photograph may contain some form of personal data where they can be processed to allow the unique identification or authentication of a natural person. David Lake Photography Ltd will never photograph an individual as a means of unique identification or authentication unless contracted to do so. Guests at events, where David Lake Photography Ltd has been contracted to capture images, appear in photos taken by David Lake Photography Ltd as a part of the documentation of the event. Guests captured in portraits or in group photos do so as part of the event and their rights are protected by David Lake Photography Ltd as detailed in this Privacy Policy.

In terms of explicit GDPR compliance, clients and guests are photographed within the parameters of GDPR legislation on the basis of legitimate interests. The taking of photographs of guests when viewed as a form of processing personal data is necessary for the legitimate interests of David Lake Photography Ltd as a photography business unless there is a good reason to protect a given individuals personal data which overrides those legitimate interests.

Operating within the parameters of legitimate interests as laid out in GDPR legislation, the disproportionate effort involved in providing Privacy Policy information to all guests at the event and the degree to which it would distract us from performing our job renders it infeasible to do. Booking clients are therefore requested in their contract to direct their guests to read this Privacy Policy in advance of the event and to advise them to contact us in advance with any concerns around the processing of their personal data, namely being photographed.

We may display any photographs to promote David Lake Photography Ltd on our website, blog, on social media, on photography related websites, in exhibitions, in advertising, brochures, magazine articles and other such material, providing that the images used are used lawfully and without damage to David Lake Photography Ltd s client(s). The rights of the people captured in these photographs are protected by David Lake Photography Ltd as detailed in this Privacy Policy.

David Lake Photography Ltd retains the full copyright of any photographs produced. Images captured at events will be retained for a minimum of ten (10) years after the date of the event.

YOUR RIGHT TO ACCESS INFORMATION OR WITHDRAW YOUR DATA

Anyone photographed by David Lake Photography Ltd, whether a client or guest, and whether past or current may withdraw consent for a photograph in which they appear to be displayed. The process for this is to email specifying the photo in question. After the request has been made, David Lake Photography Ltd will take the necessary step to remove the image online.

You have the right to contact David Lake Photography Ltd at any time and ask to view the Personal Information that the business has stored on you. You have the right to ask to have such information deleted or removed. If you would like access to your stored data, please contact David Lake at david@davidlakephotography.com

SECTION 2.1 ANALYTICS

We collect data using Google Analytics. This data is held for 26 months. This data helps us create a better experience for our users.

SECTION 3 USE OF COOKIES

When you visit our website we may also collect Cookies. These are small pieces of data that websites send to a users computer and are stored on the users web browser. They are designed to enable the website to remember information and store information about your session. This helps us monitor website traffic.

Any sub-contractors or freelancers we work with for aerial photography and editing required to fulfil your order will not have access to personal information.

There are also certain situations in which we may disclose your personal data without your explicit consent; for example, if required by law, to protect the life of an individual, or to comply with any valid legal process, government request, rule or regulation, breach of our Terms and Conditions.

We share your data in order to deliver our service to you.

SECTION 6 HOW WE PROTECT YOUR DATA

 

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. Our security measures include two factor authentication.

In the unlikely event of a criminal breach of our security we will inform the relevant regulatory body within 72 hours and, if your personal data were involved in the breach, we will also inform you.
